Arbitration Award of $98,770 for Dental Injuries

FactsOn September 3, 2005, the plaintiff Benjamin Braunstein was working as a bartender at the Pig's Eye Pub in Hartford, Connecticut when a patron, Michael Norcross, suddenly struck him in the mouth with a bottle.  Mr. Braunstein lost several teeth and required further dental work at the time of the arbitration.  The parties agreed to binding high/low arbitration with parameters of $10,000 to $100,000 less amounts paid by Mr. Norcross as part of his probation for the assault charge.


The arbitrator awarded as follows:

Past Economic Damages:  $9,370; Future Economic Damages, $14,400; Non Economic Damages, $75,000; Total:  $98,770

Settlement Efforts:  Last Demand:  $75,000; Last Offer, $40,000

Joaguin Troncoso vs. Luke Coccomo

Settlement of $53,000 for Shoulder Injury

Facts:  On April 2, 2006, the plaintiff Jocquin Troncoso was proceeding southbound on Route 9 in Middletown, Connecticut when he stopped for a traffic light.  While he was stopped, he was suddenly struck in the rear by a vehicle operated by the defendant Luke Coccomo.  Mr. Troncoso incurred roughly $20,000 in medicals, including shoulder surgery for a rotator cuff repair. He was assessed as having a 6% permanent impairment of the left shoulder.  The case was settled prior to trial. The medicals were paid through health insurance with no lien.
